TERMS AND CONDITIONS OF HIRE
General
1.1 The “client” means the person(s) or organisation or company booking the equipment
1.2 The “company” means Capital Booths.
Bookings
2.1 The equipment remains the property of the company at all times.
2.2 By placing an order with us either verbally or via e-mail regardless of whether a booking form has been returned or deposit paid it is deemed that the customer has read, understood, fully agreed to and is bound by all our terms and conditions of hire.
2.3 We shall have no liability for delays or failures in delivery of performance of our obligations to the client resulting from any act, event, omissions, failures or accidents that are outside of the company’s control.
2.4 Liability shall be limited to a refund of any monies paid in relation to the contracted event or a pro rata reduction in the hire fee in the event of delayed start. No further compensation will be paid irrespective of any loss of earnings.
2.5 All hires are subject to a non-refundable deposit of £50
Payment terms
3.1 Unless otherwise agreed in writing, the balance shall be paid in full at least 14 days prior to the date of the event.
3.2 Unless otherwise agreed in writing, if the client’s event is 14 days or less from the date of booking then the full balance shall be due at the time of booking.
3.3 Advertised prices are subject to change without prior notification.
Cancellations
4.1 Any cancellation is subject to the following cancellation charges:
Within 8 weeks prior to the event 25% of order value.
Within 6 weeks prior to the event 50% of order value.
Within 4 weeks prior to the event 75% of order value.
Within 2 weeks prior to the event 100% of order value.
4.2 Cancellations within 7 days of booking: free of charge, any deposit shall be refunded. The only exception to this is when the event date is 7 or fewer days from the date of booking. In this instance the client shall be liable to make full payment and shall not be entitled to any refunds.
Site location, facilities and conduct
5.1 The client shall provide the company a suitable location for the equipment hired to be erected and used properly.
5.2 A suitable space is defined as clean, safe, dry, and at least 9ft wide, 6ft deep and 7ft high with suitable 1kw 13A power supply within 2 meters.
5.3 If the space allocated is unsuitable on arrival or if the space becomes unsuitable during the hire duration then the company has the right to cancel the hire subject to cancellation terms set out in this document.
5.4 The client must ensure that the allocated space is within 50 meters of a suitable parking space for 1 x 2.5 ton van. The route from van to allocated space must be level and free of steps to allow a heavy, wheeled flight case measuring 75cm wide 130cm long and 100cm tall good access.
5.5 The parking will be provided at the client’s expense for the duration of their event and any period where the company is required to be on site.
5.6 The client is responsible for ensuring that suitable security and crowd control measures are in place.
5.7 The company has the right to cease operation and remove the hired equipment form the site if the company feels that the guests or clients conduct endangers the safety of the guests, clients, themselves or the safety of the hired equipment. No refund will be given and full contracted fees will be due to the company.
Damage to Equipment
6.1 The costs of any repairs following damages and/or losses to our equipment shall be charged to the client in the event that any part of our equipment is lost or damaged during the client’s event.
Use of images
7.1 Unless otherwise agreed in writing the client grants the company full rights to use any images taken at the event (inside or outside of the booth) on the company’s website, in social media and in other marketing material without limitation.
7.2 The company agrees to provide the client with a copy of all images captured at the event either via CD/ DVD, USB Drive and/ or Online gallery hosted by the company giving the client unlimited use of those images.
